You do not know what you do not know. 

November 19, 2024 is a good day for the federal government.  Today, the federal government currently has 126 documents from 42 agencies (278 Pages) with 104 Notices, 1 Presidential Documents, 7 Proposed Rules, 14 Rules, and 3 Significant Document.    With this current issue, Federal Register / Vol. 89, No. 223 / Tuesday, November 19, 2024 / Notices is up to page 91524.  The federal government is busy.

The one presidential document:


America Recycles Day, 2024
by the Executive Office of the President on 11/19/2024.

This proclamation recognizes the role of recycling.  America Recycling Day is proclaimed to be November 15, 2024.   On this day, we learn that recycling is good.  So, with this proclamation, Does Recycling Work? 

No! It might make you feel better about yourself.

 

The three Significant Documents:

Export Administration Regulations: Revisions to Space-Related Export Controls, Including Addition of License Exception Commercial Space Activities (CSA); Extension of Comment Period by the Industry and Security Bureau on 11/19/2024.

This proposed rule extends the comment period to December 23, 2024.  To make a comment, you would need to access the document BIS_FRDOC_0001-0677 on https://www.regulations.gov/document/BIS_FRDOC_0001-0677.

The summary for this document, “On October 23, 2024, the Bureau of Industry and Security (BIS) published in the Federal Register the proposed rule, “Export Administration Regulations: Revisions to Space-Related Export Controls, Including Addition of License Exception Commercial Space Activities (CSA)” with comments originally due November 22, 2024. This notification extends the deadline for written comments to December 23, 2024. This extension is being made to allow for commenters to have additional time to review the proposed rule and to be informed by the public outreach that BIS is conducting on the rule in preparing their comments. Extending the public comment period will not in any way undermine the rule or national security of the United States.

Third Temporary Extension of COVID-19 Telemedicine Flexibilities for Prescription of Controlled Medications by the Drug Enforcement Administration and the Health and Human Services Department on 11/19/2024.

This is a temporary rule.  This is currently extended to December 31, 2025.  Started during the COVID days. 

The summary, “The Drug Enforcement Administration (DEA) in concert with the Department of Health and Human Services (HHS) is issuing a third extension of telemedicine flexibilities for the prescribing of controlled medications, through December 31, 2025.

Just as the title suggests, this is the third extension of these rules.  To question, why an extension instead of a regulation, instead of a law, or any other action.  Once created, do these activities ever end?

 


International Traffic in Arms Regulations: U.S. Munitions List Categories IV and XV; Extension of Comment Period
by the State Department on 11/19/2024.

This proposed rule extends the comment period to December 23, 2024. 

The supplemental information, “On October 23, 2024, the Department of State published a proposed rule (89 FR 60980) proposing revisions to the International Traffic in Arms Regulations (ITAR, 22 CFR parts 120 through 130). Specifically, the publication proposed to amend the ITAR to revise U.S. Munitions List (USML) Categories IV and XV and related sections of the ITAR to clarify and standardize the regulatory text, add items that warrant designation on the USML, and remove those items that no longer warrant designation on the USML. The publication further proposed to add three new license exemptions to the ITAR and requested public comment by November 22, 2024. In response to requests received from the public to extend the comment period, the Department of State is extending the comment period for the proposed rule for an additional 30 days, through December 23, 2024.

Either you are an expert and will know something about this otherwise, it appears that this is quite complicated.  Not sure how the average citizen can be informed enough to provide comment.  Maybe someone has an answer.

 

SPECIAL ITEM:

Privacy Act of 1974: Implementation of Exemptions by the Homeland Security Department on 11/19/2024.

This final rule is effective November 19, 2024.  The summary, “In accordance with the Privacy Act of 1974, the U.S. Department of Homeland Security is issuing a final rule to amend its regulations to exempt portions of a newly established system of records titled, “U.S. Department of Homeland Security/Federal Emergency Management Agency-015 Fraud Investigations System of Records” from specific provisions of the Privacy Act. This system of records includes records on individuals being investigated for or involved in an investigation relating to the misuse of federal disaster funds and/or benefits. Specifically, the Department exempts portions of the “-DHS/FEMA-015 Fraud Investigations System of Records” from one or more provisions of the Privacy Act because of criminal, civil, and administrative enforcement requirements.

This is a special item due to the nature or privacy.  Today, privacy is something which is taken for granted.  One of the big items in this document, “When a record received from another system has been exempted in that source system under 5 U.S.C. 552a(j)(2), DHS will claim the same exemptions for those records that are claimed for the original primary systems of records from which they originated and claims any additional exemptions set forth here.” When information is transferred from one system to another, the exemption is carried over.   The exemption include:

  1. Accounting for Disclosures
  2. Access and Amendment to Records
  3. Relevancy and Necessity of Information
  4. Agency Requirements
  5. Agency Rules

Each of these terms have a specific definition, which benefit the agency and provide a model for release on a case-by-case basis.   

Free speech and privacy are quite important, understanding government’s role in limits is important.  I only wish that in the future, more people would provide comment to any rules implements which affect free speech or privacy.

 

US Debt Clock Update

Setting new records every day! 

According to the US Debt Clock at roughly 9:49 AM, the US debt is roughly $36,011,844,000,000.    Each taxpayer’s debt is $272,821.   The good news is that the federal government revenue is roughly $5,044,850,000,000.  Not too shabby if you ask me. 

Special Note: Interest of Debt (Net) is $996,724,000,000.
